1. Acceptance of Terms

By downloading, installing, accessing, or using WhoWon ("the App"), operated by Storq Labs ("we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any modifications.

2. Entertainment Purpose Only

The App does NOT provide:

• Legal advice or legal opinions
• Financial, investment, or business advice
• Relationship, marriage, or counseling advice
• Medical, psychological, or mental health advice
• Professional advice of any kind

Any decisions you make based on content from this App are made at your own risk. We strongly recommend consulting qualified professionals for any serious matters.

3. AI-Generated Content Disclaimer

The verdicts and analyses provided by WhoWon are generated by artificial intelligence. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, biased, or inappropriate
• The AI does not have full context of your situation and cannot understand nuance
• Results are based on limited information from uploaded screenshots only
• The AI may make errors in interpretation or judgment
• We make no representations about the accuracy, reliability, or completeness of any verdict
• Verdicts should not be used as evidence or documentation in any legal, professional, or personal dispute

4. Eligibility and Age Requirements

You must be at least 13 years old to use this App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the App with parental or guardian consent. By using the App, you represent that you meet these requirements.

5. User Conduct and Content

You agree NOT to upload, submit, or share:

• Content involving minors or child exploitation
• Non-consensual intimate images or "revenge porn"
• Content that violates others' privacy rights
• Illegal content or content promoting illegal activities
• Harassment, threats, or content promoting violence
• Content you do not have the right to share
• Malicious files, viruses, or harmful code

You are solely responsible for all content you upload. We reserve the right to refuse service, terminate accounts, and report illegal content to authorities.

6. Subscriptions and Payments

WhoWon offers optional auto-renewable subscription plans ("WhoWon Pro"). By subscribing, you agree to the following:

• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Billing: Payment is charged to your Apple ID account at confirmation of purchase and upon each renewal
• Price Changes: Prices may change with notice; continued use after price changes constitutes acceptance
• Cancellation: You may cancel anytime through your Apple ID account settings. No refunds for partial subscription periods
• Free Trials: If offered, unused portions of free trials are forfeited upon subscription purchase

Refund requests are handled by Apple according to their policies. We do not process refunds directly.

7. Intellectual Property

All content, features, and functionality of the App (excluding user-uploaded content) are owned by Storq Labs and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use our trademarks without permission

You retain ownership of content you upload but grant us a limited license to process it for providing the service.

You agree to indemnify, defend, and hold harmless Storq Labs and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you upload or share; or (e) any dispute between you and a third party related to content analyzed by the App.

11. Dispute Resolution and Arbitration

Informal Resolution: Before filing any legal claim, you agree to contact us at our support page to attempt informal resolution for at least 30 days.

Binding Arbitration: Any disputes not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be conducted in English, and the arbitrator's decision will be final and binding.

Class Action Waiver: YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. If this waiver is found unenforceable, the entire arbitration provision shall be void.

12. Termination

We may suspend or terminate your access to the App at any time, for any reason, without notice or liability. Upon termination, your right to use the App ceases immediately. Sections regarding disclaimers, limitations of liability, indemnification, and dispute resolution survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of courts located in Delaware.

14. Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storq Labs regarding the App and supersede all prior agreements and understandings.
